They and others argue that RBG’s statements are politicizing the Supreme Court, which could be potentially disastrous if a situation like Bush v. Gore were to happen with Trump and Clinton in this election.
Trump responds to RBG: “Highly inappropriate that a U.S. Supreme Court judge gets involved in a political campaign"https://t.co/2GpJxizKnM
Critics are saying that because of her statements RBG would have to recuse herself if the Supreme Court were to see any cases involving Trump.
Beyond that, critics are saying it sets a bad precedent for a sitting Supreme Court justice to make political statements. The Supreme Court must be a place that is above the political fray.
On the other hand, people are pointing to the fact that the Supreme Court is already politicized. What's new is that a justice is saying this publicly. And while this is an unprecedented move for a Supreme Court justice, we live in unprecedented times. Glenn Greenwald said it best:
Hard to take seriously court impartiality/Ginsburg furor after 5 GOP-appointed judges stopped vote-counting & made George W. Bush president
Trump’s inflammatory rhetoric has never been seen from a leading presidential candidate. RBG’s supporters are saying that since Trump is crossing so many dangerous lines, maybe others should cross lines to oppose him.
Not to defend RBG's remarks on Trump, but in general the notion that SCOTUS is apolitical is a giant myth. https://t.co/YkYYArqquU
