Should Neil Gorsuch be removed from the Supreme Court?

Supreme Court justices have lifetime appointments, but the U.S. Constitution leaves open the possibility of impeachment. Many believe Neil Gorsuch should be removed from the Supreme Court. He's occupying Merrick Garland's stolen seat and was appointed by someone who many on the left see as an illegitimate president. But even critics of Gorsuch argue talks of impeachment are crazy. Not only will it never happen, it would set a wildly dangerous precedent that Congress can impeach justices it does not like. What do you think?

Supreme Court justices have lifetime appointments, but that hasn't stopped some from calling for the impeachment of Neil Gorsuch. In U.S. history, only one Supreme Court Justice has ever actually been impeached (but not convicted) and one resigned under the threat of impeachment.

The purpose of a lifetime appointment was to give them freedom to make decisions without interference from the executive or legislative branches of government. But the Constitution leaves open the possibility of impeachment and removal by Congress. In U.S. history, one justice was impeached, but not convicted, and one justice resigned under the threat of impeachment.

The U.S. Constitution guarantees Supreme Court justices "shall hold their Offices during good Behavior," but what exactly constitutes bad behavior?

As one Daily Kos commenter put it: why not try? Republicans used ruthless, unethical methods to keep Merrick Garland from joining the Supreme Court. Why shouldn't Democrats retaliate if they take back Congress in 2018?

Outrageous, unjustified, and far-fetched? No more than McConnell/Grassley & Republicans’ criminally unconstitutional, historically unprecedented, totally reprehensible refusal to even grant Garland hearings, much less a vote. Gorsuch is likely guilty of plagiarism, hardly an impeachable offense, but the beauty is that no real grounds are necessary. Just play by the same sleazy lack of any integrity and principles.

As far as many on the left are concerned, Gorsuch was appointed by an illegitimate president and is sitting in a stolen seat. If ever there was a time to remove a Supreme Court justice, it is now.

But others don't believe Democrats have the spine to impeach Gorsuch—even if they do regain control in Congress.

Others say no matter how much you hate Gorsuch, he hasn't committed an impeachable offense. Do we really want to set a precedent that allows Congress to impeach Supreme Court justices it does not like? The entire purpose of lifetime appointments is to shelter justices from the whims of partisan politics.

But many liberals are tired of bringing knives to gun fights. Republicans defied all norms in order to keep Merrick Garland off the bench, why can't Democrats use the same methods to remove Gorsuch?
